DOJ Files Lawsuit Against Uber for Discrimination

Wooden puzzle pieces with cutouts showing symbols for accessibility, people, and justice scales, representing disability rights and legal protection.

The Department of Justice recently filed a lawsuit against Uber for allegedly discriminating against passengers with disabilities, including those that use stowable wheelchairs and travel with service animals. The lawsuit is seeking $125 million for those that have submitted complaints of discrimination to both Uber and the Justice Department.

DOJ Seeking $125 Million in Uber Discrimination Case

The discrimination lawsuit, which was filed in the U.S. District Court for the Northern District of California on Thursday, October 2, 2025, alleges that Uber violated Title III of the Americans with Disabilities Act (ADA). The ADA, which prohibits discrimination by private companies, also requires Uber to let service animals accompany passengers in vehicles. Uber isn’t just required to provide rides, but also assist riders traveling with stowable wheelchairs and mobility devices.

The lawsuit further alleges that Uber and its drivers have refused to accept rides for passengers with disabilities and have even gone as far as imposing impermissible surcharges, including cleaning and cancellation fees to riders that Uber denied service to. Additionally, because of Uber’s policies and practices, many riders with disabilities have experienced significant delays in being picked up, missed appointments, and being stranded in poor weather. The lawsuit is also seeking a court order to stop Uber, not only from discriminating against passengers, but to train staff and drivers about the ADA and modify its policies.

Per Assistant Attorney General of the Justice Department’s Civil Rights Division, Harmeet K. Dhillon, “This lawsuit seeks to end this persistent discrimination and allow riders with disabilities to use Uber. We will enforce the ADA’s guarantee that people with disabilities have equal opportunity and full participation in all aspects of American society, including transportation.”

Not the Only Example of Uber’s Bad Policies

Uber’s discrimination against its passengers is, unfortunately, not the only example of their bad business practices. In March, we reported on a New Jersey couple who were involved in an Uber accident, suffering serious injuries. Instead of taking accountability, Uber forced the injured couple into arbitration, claiming that they gave up their right to move forward with a claim because they had agreed to the arbitration clause after signing up for Uber Eats.

While a lower court initially ruled in favor of the couple, a New Jersey appeals court reversed the decision stating that the arbitration clause was binding.
