After your auto accident, New Jersey law states that you have two years to file a lawsuit to seek compensation for your injuries. This period may be extended in certain circumstances, such as when the injured party is a minor child, or if the injured party was the victim of a hit-and-run and does not immediately discover the identity of the other driver. If you file your lawsuit after the two-year statute of limitations expires in your case, the trial court can permanently dismiss your lawsuit. In addition, if you are involved in an auto accident with a government vehicle, you have an even shorter period of time in which to provide the government with notice of your claim for compensation.
After your accident, the important thing to remember is not to offer an apology or try to assign blame for the accident — your statements may later be used as evidence that you were at fault. Let the insurance companies and attorneys sort out fault for your accident. Even if you are found to share some portion of fault for your auto accident, you may still be entitled to seek compensation under New Jersey’s modified comparative negligence rule, provided that you are not more than 50 percent responsible for the accident. However, your compensation from the other party will be reduced by your percentage of fault for the accident.
