When a car accident results in a fatality, the family of the decedent may be eligible to file a wrongful death claim if there is significant evidence indicating that the fatal event was caused by another party’s actionable behavior. For this reason, many bereaved families seek the counsel and representation of a personal injury attorney in the aftermath of an accident like the one in Tuckahoe on Aug. 30.
An attorney may advise family members of a deceased accident victim whether a wrongful death suit appears tenable. If so, the lawyer may, furthermore, file all the requisite paperwork and assemble the necessary materials and resources together to build a strong wrongful death case. In order to prevail, claimants in a wrongful death suit must demonstrate to a civil court that the fatal accident could have been avoided if not for the actionable behavior of the defendant.
Moreover, claimants must demonstrate the exact pecuniary losses they suffered as a result of the deadly crash. If successful, claimants might be awarded financial compensation for end-of-life expenses as well as lost earnings if the decedent had contributed income to the family household prior to death.
