Woman Who Broke Ankle on Water Slide at Ocean County Six Flags Amusement Park Files Lawsuit

A woman who broke her ankle while riding a water slide at Six Flags Great Adventure in Jackson Township NJ has filed a personal injury lawsuit.

The amusement park accident occurred in 2015 at the Six Flags Great Adventure park in Ocean County, New Jersey. The victim, a 20-year-old Brooklyn woman, was sharing a tube on the King Cobra water slide at the popular Hurricane Harbor section of the amusement park when she slammed into the slide and sustained significant physical injuries.

The amusement park accident victim is now alleging negligence on the part of the water slide operators and is seeking $3 million in damages. The lawsuit names the owners and operators of Six Flags as defendants because the plaintiff is suing under a theory of premises liability. In New Jersey, premises liability law requires property owners to correct an unsafe or defective condition on their property or to at least warn site visitors of the defective condition. In this instance, the Brooklyn NY woman alleges, Six Flags was negligent and failed to ensure that people riding the King Cobra water slide would be safe from injury.

According to the plaintiff’s lawyer, she was riding a double tube with a friend – even though only single tubes are allowed on the King Cobra water slide at the Jackson NJ amusement park. The plaintiff is expected to argue in court that Six Flags employees should have seen the pair carrying a double tube and prevented them from getting onto the waterslide in the first place. The defendants may attempt to argue the plaintiff was responsible for her own injuries; it will be interesting to see whether that allegation can be established given the Six Flag’s employee’s failure to warn that this could be dangerous and may cause injury.
