Toxic torts is a familiar way to refer to product liability or other negligence claims that result from exposure to chemicals and products that have been proven to cause illness when ingested, inhaled, or enter the blood stream through direct contact. As in all product liability claims, there are three grounds for filing a legal cause of action to recover compensation for injury and losses resulting from toxic illness:

  • Negligence on the part of the manufacturer, distributor, or property owner
  • Breach of warranty on the part of the manufacturer or distributor
  • Strict product liability on the part of the manufacturer, packager, or distributor. In landfill cases, owners and operators of the disposal site, generators and haulers of toxic waste may be held strictly liable based upon a landmark case our firm handled in the 1980s.

We are the firm that was involved in the landmark toxic tort decision of Kenney v. Scientific, Inc. the first case in New Jersey that established strict liability on the part of generators and haulers of toxic materials, and landfill operators that accepted the toxic waste.
